These General Conditions of Sale are governed by the Consumer Code (Legislative Decree no. 206/2005), section II, Distance contracts (articles 50 – 67) as amended by Directive 2011/83 EU implemented by Legislative Decree of 3 December 2013 and by the rules on electronic commerce (Legislative Decree no. 70/2003) and apply to the sale of products via Internet, as identified and listed on the Website. The Customer is invited to print or keep these General Conditions in the preferred manner. In case of changes to the General Conditions, the Purchase Order (hereinafter "Purchase Order") will be subject to the General Conditions published on the Website at the time the Order is sent by the Customer. By sending the order, the Customer declares to have read, understood and accepted these Conditions of Sale.

The conditions of sale regulate distance purchases of goods offered on the aquascutum-active.com website. The customer by submitting his order on the website accepts the following conditions and declares to have read them.
1) * Shippings
aquascutum-active.com uses the best delivery companies in the industry to ensure that your order is delivered on time.
Aquascutum Active sells throughout Europe and most of the world, including the United States and Canada.
For not-CEE countries, shipping, returns, taxes and customs duties are in charge of the customer.

The shipment will be carried out after receiving the payment. (except for cash on delivery).
Standard delivery is available from Monday to Friday.
Delivery times may vary if the recipient's address is located in a remote area and / or island.
Factors such as postal or courier delays, logistical problems, adverse weather conditions or the inability of our couriers to reach the recipient, at the delivery address provided when ordering, for incomplete or inaccurate data, may also affect the punctuality of deliveries.
We do our best to ensure that orders are delivered by the scheduled dates, but, on rare occasions, there may be delays in deliveries, particularly during some busy periods (sales and holidays).
Express Shipping:
Express delivery is available from Monday to Friday.
Orders placed after 12 noon will be delivered within 2 working days after processing.
No deliveries are made at weekends.
Orders placed after 12:00 noon on Fridays will be processed and shipped on Mondays.
If your delivery date coincides with a holiday, your order will be delivered on the first available working day.
No deliveries are made on national holidays.
Any delays or non-deliveries by the courier are not directly attributable to ICONS SRL.
We will do everything possible to keep you updated on delivery and you will still be able to track your package through the shipping number to be entered on the courier's website.
We do not ship to PO Boxes but only to physical addresses.

When checking out, select InPost as your courier. Wait for our notification to pick up your parcel at one of the Locker or InPost Points.
You can pick up your parcel within 30 days after notification. After this period, the parcel will return to the sender.

2) Prices
The prices of the products displayed are VAT included and can be changed at any time.
In addition, during checkout, before payment, the total cost of the order will be summarized, which can be modified or totally canceled.
3) Liability and warranty
ICONS SRL is not responsible for any damage or loss, direct and / or indirect, from the sale of the items proposed in the published catalog, nor for delayed and / or non-delivery of the product, nor for any other fact not directly attributable to our company.
ICONS SRL assumes no responsibility for loss of objects after delivery, nor for damages due to the use of clothing, footwear and accessories.
The warranty terms applied are those provided by the manufacturer. It is the customer's responsibility to verify the quantity and good condition of the goods at the time of delivery.
When the Customer finds that the goods are damaged or do not comply with the quantities ordered then the same must report it to the carrier and sign the delivery document with reserve as well as inform ICONS SRL within 3 days of receipt of the shipment. ICONS SRL will provide (verified that the Product (s) subject to Return is / are intact , inserted in the original packaging, complete in all its parts, including packaging and accessory documentation) to the possible replacement of the missing or damaged goods and in accordance with the Purchase Order made.
4) Payments
Payments are administered by LDA Fashion srl VAT 14345861000 - Via delle Genziane 13E – 00012 Guidonia (RM) IT.
The payment of your order can be carried out in the below methods:
PayPal – Fast and 100% safe
Credit card – Secure payment on Shopify Payment checkout
Cash on delivery (only for Italy) – Cash payment to the courier; additional cost of €4,90; For orders up to €400. (not available for pre-order items).

All Credit and Debit card transactions are debited at the point of purchase.
5) Returns and refunds
Pursuant to Legislative Decree no. 206/2005, the customer has the right to cancellation within 14 days of receiving the order.
The return is free only for Italy. Only the items will be refunded and not the ancillary costs.

The returned product must be intact, undamaged, unused or washed, with the original label, plastic packaging and box where the product has arrived.
To request the return sent email to info@aquascutum-active.com with order number and the reason for return.
Refund in case of return will be issued within 14 days after receipt of the return. All incidental charges paid (standard or express shipping and the cost of cash on delivery) are excluded from the refund.
For shipments to countries that do not use the euro (€) as their local currency, additional currency conversion costs may apply. These costs will be borne by the customer and will be calculated according to the policies of the payment provider or bank used.
Cancellation of orders is only permitted before shipment. Once the order has been shipped, it will no longer be possible to cancel it.
6) B2B
Aquascutum-active.eu deals exclusively with B2C customers, not B2B customers. B2B purchases may be cancelled without prior notice.
7) Product Availability
Aquascutum-active.com reserves the right to accept or not the orders that will be placed and in any case until the goods are out of stock. In case of non-acceptance of the order (eg: Product not available), following an information email, we will propose the re-crediting of any amounts paid or the choice of an alternative product.
8) Use of images
The images pubblished on the aquascutum-active.com website are the property of ICONS SRL Any use of these images, not authorized by a written consent by ICONS SRL will be prosecuted in accordance with the law.
9) Sensitive data
Your credit card details are managed by the PayPal service. The company ICONS SRL and those who work won’t be aware of this information. If you choose PayPal as a payment method, carefully read the terms of service on the reference website.

11) Alternative dispoute resolution (ADR) /On line dispute resolution (ODR)
EU Regulation no. 524/2013 and Legislative Decree no. 130/2015 have introduced legislation aimed at facilitating the out-of-court settlement of disputes between consumers and traders relating to a product or service purchased online. 12) Applicable law, jurisdiction and place of jurisdiction for non-consumer users
These Conditions are subject to Italian law. For all orders from subjects who do not qualify as "consumers", all disputes relating to the interpretation and / or execution of this contract, will be the exclusive competence of the Firenze forum.
For consumer customers, it must be understood that the place of jurisdiction remains the consumer's court.
